四、保证金：

六、甲方的责任：

6.2 租赁期内甲方不得收回出租房屋(除非本合同另有规定)，甲方保证乙方可不受干扰的享用该物业。

七、乙方的责任：

7.1 乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。

7.2 乙方应爱护使用出租房屋，如因乙方的过失或过错致使房屋设施及屋内用具和饰品受到损坏(正常损耗除外)，乙方应负赔偿责任。

根据《中华人民共和国合同法》、《上海市房屋租赁条例》的规定，甲、乙双方在平等、自愿、公平和诚实信用的基础上，经协商一致，就乙方承租甲方可依法出租的房地产事宜，订立本合同。

合同法对转租合同还是有限制的必要性，主要体现在：
一是转租合同的期限。
转租合同的期限不能超过已租赁合同的期限，以防止原租赁合同到期但转租合同而没有到期导致原出租人收回租赁物比较困难的情况出现;
二是转租合同中对标的物的使用程度。
转租合同所约定的对租赁物的使用致使租赁物危害(即正常使用所致消耗及损害)程度不能大于原租赁合同，以避免次承租人对租赁物的正常使用给租赁物造成的磨损大于出租人的预期。因为出租人对承租人如何使用租赁物是有预期的，并把这样一种预期与租金的支付相联系。如果次承租人对租赁物的正常使用给租赁物造成的磨损大于原承租人的预期，而租金却又没有增加，那就是对原出租人不公平。

根据《中华人民共和国合同法》、《中华人民共和国城市房地产管理法》及其他有关法律、法规规定，在平等、自愿、协商一致的基础上，甲、乙双方就下列房屋的租赁达成如下协议：
第一条房屋基本情况
甲方房屋（以下简称该房屋）坐落于________；位于第____层，共______〔套〕〔间〕，房屋结构为_________，建筑面积_______平方米（其中实际建筑面积_______平方米，公共部位与公用房屋分摊建筑面积_______平方米）。
第二条房屋用途

第八条维修养护责任
租赁期间，甲方对房屋及其附着设施每隔____〔月〕〔年〕检查、修缮一次，乙方应予积极协助，不得阻挠施工。正常的房屋大修理费用由甲方承担；日常的房屋维修由____方承担。因乙方管理使用不善造成房屋及其相连设备的损失和维修费用，由乙方承担责任并赔偿损失。租赁期间，防火安全、门前三包、综合治理及安全、保卫等工作，乙方应执行当地有关部门规定并承担全部责任和服从甲方监督检查。
第九条关于装修和改变房屋结构的约定
乙方不得随意损坏房屋设施，如需改变房屋的内部结构和装修或设置对房屋结构影响的设备，需先征得甲方书面同意，投资由乙方自理。退租时，除另有约定外，甲方有权要求乙方按原状恢复或向甲方交纳恢复工程所需费用。
第十条关于房屋租赁期间的有关费用
在房屋租赁期间，以下费用由乙方支付，并由乙方承担延期付款的违约责任：

4、房屋只限乙方使用，乙方不得私自转租、改变使用性质或供非法用途。租下本房后，乙方应立即办好租赁登记、暂住人口登记等手续。若发生非法事件，乙方自负后果。在租赁期限内，甲方确需提前收回房屋时，应当事先商得乙方同意，给乙方造成损失的，应当予以赔偿。
5、合同一经签订，双方都不得提前解除。租赁期内，如遇不可抗力因素导致无法继续履行本合同的，本合同自然终止，双方互不承担违约责任。
6、甲乙双方约定，乙方如需开具房租发票，因此产生的税费由乙方支付。
7、此合同未尽事宜，双方可协商解决，并作出补充条款，补充条款与本合同有同等效力。双方如果出现纠纷，先友好协商，协商不成的，由人民法院裁定。
8、本合同经签字（盖章）生效。
